How Tier II Reporting Works in Pennsylvania

Pennsylvania files through its own system, PATTS, run by the Department of Labor and Industry's Bureau of Occupational and Industrial Safety -- and the state is explicit that no other electronic reporting program, including E-Plan or Tier2 Submit alone, satisfies the requirement.

PATTS -- the Pennsylvania Tier II System -- is the Bureau of Occupational & Industrial Safety's dedicated reporting platform, sometimes referred to as the Pennsafe Program. It's the sole state repository for Tier II data.

Who has to file, and when

Standard federal thresholds -- 10,000 pounds for hazardous chemicals, 500 pounds or the TPQ for extremely hazardous substances.40 CFR 370.10 The annual report is due online by March 1st.

One filing, most of your local requirements handled

Here's the part that's genuinely more convenient than most states: with the exception of Berks County, Pennsylvania's county LEPCs are signatory partners with the Bureau, meaning they accept your PATTS filing as satisfying their own requirement too. You don't file separately with most county LEPCs the way you would almost everywhere else on this list. Your local fire department still needs its own copy -- PATTS can generate a hard copy for that purpose.

Pennsylvania's own guidance is direct: a Tier II submission through any other online or electronic reporting program does not meet the state's filing obligation. PATTS is the only system that counts here.

Paying the fee

PATTS generates a signed Invoice/Certification Form as part of your online submission. You return that form along with the state-level fee payment -- check or money order, made payable to the Pennsylvania Hazardous Materials Response Fund -- to the address the system provides. The certification and the payment travel together, not as two separate steps you might lose track of.
